How many patents does it take to signal innovation quality?

چکیده

In this paper, we offer a novel explanation to the surge in patenting observed during the last few years. When PTOs (Patent and Trademark Offices) award bad patents, not only do “false innovators” have the incentive to file applications but also, and more interestingly, “true innovators” are forced to patent more intensively in an attempt to signal their type. However, if they are liquidity constrained, true innovators may fail to separate and this fact reduces the incentives to exert effort in R&D. In addition, drawing on the signaling role of patents highlighted by the model, we investigate some of the proposals that have been put forward in order to mitigate the bad patents problem. We provide an intuitive condition under which a tightening of the patentability standards (“raising the bar”) reduces the distortions caused by bad patents. Moreover, we show that introducing a two-tiered patent system is unlikely to improve market outcomes. J.E.L. codes: L13, O31, O34.

This paper studies a simple model of experimentation and innovation. Our analysis suggests that patents may improve the allocation of resources by encouraging rapid experimentation and efficient ex post transfer of knowledge across firms. Each firm receives a private signal on the success probability of a research project and decides when and which project to implement. A successful innovation ...

How to find a Software Patent?

Many software patents have become known by simply reading the patents in the patent databases. This is, however, a Gargantuan task and a more systematic and automatic method is needed when performing large scale legal and economic studies. Usually, software patents are identified as those patents that satisfy a simple query on the title and the specification of the patent itself. Typically, the...

The development and evolution of any system–person, organization–nation depends on how the system succeeds to bridge the gap between what the system knows and what the system does (with the knowledge). We call this the gap between knowing and doing or the knowing-doing gap. If the system does not do what it knows, it will lose out in competition with other systems, its relative performance in...
